Former NFL quarterback Mark Sanchez agreed to plead guilty Thursday. The case stems from an October 2025 altercation with a 69-year-old truck driver in Indianapolis.
His attorneys filed a motion in Marion County Superior Court. They asked the judge to cancel the trial. They want a guilty plea and sentencing hearing set instead. A judge must still accept the plea.
**What happened that night**
Perry Tole, 69, was working near a downtown Indianapolis hotel. He was collecting used cooking oil from an alley. Police were called around 12:35 a.m. on October 4, 2025.
A police affidavit alleges Sanchez smelled of alcohol. He confronted Tole over a parking dispute, the affidavit says. Video showed Sanchez grabbing Tole and throwing him toward a wall. Tole pepper-sprayed him. Sanchez slowed only briefly. When Sanchez advanced again, Tole pulled a knife.
Sanchez went to the hospital with stab wounds to his upper right torso. Tole was cut through the cheek. At the hospital, Sanchez told officers his only memory was reaching for a window.
**The charges**
Sanchez was charged with one felony count of battery resulting in serious bodily injury. That charge carries one to six years in prison. He also faces three misdemeanors: public intoxication, battery resulting in injury, and unlawful entry of a motor vehicle. Online records do not show which specific counts he plans to plead to.
Marion County Prosecutor Ryan Mears upgraded the case to a felony two days after the incident. He cited Tole's age and the extent of his injuries. Investigators found the surveillance footage matched Tole's self-defense claim.
**Both sides say talks are going well**
Nick Sanchez Jr., the former quarterback's brother and legal adviser, called Thursday's motion a positive development. He said an agreement with prosecutors is being finalized.
Matt Golitko, Tole's attorney, agreed talks have been productive. "Mr. Tole appreciates the progress we have achieved and looks forward to an amicable resolution," Golitko said.
**What comes next**
Fox Sports cut ties with Sanchez in November 2025 and replaced him with Drew Brees. Tole has also filed a civil lawsuit against Sanchez and the network. That case is still pending.
Defense attorneys requested sentencing on November 9 or November 16. The trial had been delayed five times before this motion.
Watch the sentencing date for what Sanchez actually owes under the law. The civil case against Fox Sports is still open, and Tole is still seeking accountability there.
